Kathleen DeLacy is a partner at the firm’s Wilmington, Delaware office in the Wills, Trusts, & Estates practice area, and the Business Succession Planning, and Real Estate Groups, Kathy has been assisting businesses and individuals throughout Delaware for more than 19 years and shares time between the firm’s Wilmington and Rehoboth Beach offices to accommodate the needs of clients statewide.
Kathy has extensive experience offering estate planning, estate and trust administration and probate services as well as elder law assistance, including asset protection planning for long-term care (Medicaid and VA). She assists clients with estate planning issues, particularly in light of the complex issues facing same-sex couples and the newly enacted law allowing same-sex couples to marry in Delaware, and she handled the first same-sex adoption case which set a precedent in the state of Delaware.
Additionally, Kathy recently established the Firm’s Real Estate Closing Practice in Delaware, where she assists clients through every step of the residential and commercial purchase as well as 1031 exchanges and the refinance process, now focusing on commercial real estate. This practice includes the review of all contracts, mortgage documents, titles and surveys, and prepares the necessary documents for the Closing. Kathy also travels to closings at a location convenient to her clients. Offering a sophisticated, cross-disciplinary approach to the representation of real estate closing clients allows her to offer an additional level of service and support unmatched by our legal counterparts.
Kathy is a member of the bar of the Supreme Court of the State of Delaware, a 1995 Magna Cum Laude graduate of Widener University and a 2000 graduate of Widener University School of Law. She is a frequent lecturer and presenter focusing on a wide range of topics, including estate planning, estate administration, guardianships, elder law and Medicaid-related matters. Additionally, she is the Past President of the Southern Delaware Estate Planning Council and currently serves on the Council’s Board of Directors and is also the Past Chairman of the Elder Law Section of the Delaware State Bar Association. Kathy is also a certified Mediator in the areas of estates and will contests, guardianships, family law and any other related topics.
Kathy is the Chairman of the Finance Committee for Atonement Methodist Church. She presents seminars on a quarterly basis to the Newark, DE Senior Center on various topics, including estates and trusts, estate administration, guardianships, elder law, Medicaid planning and other issues of interest to their members. She also spends one day a month at other Senior Centers throughout Delaware for at least three hours a day providing pro bono consultations to their members. She also is an approved instructor for The Money School and holds seminars several times a year through The Money School in libraries in all 3 counties in Delaware.
Outside the office, Kathy enjoys traveling and spending time with her husband, two children and five grandchildren.
