Kathleen DeLacy is a Partner in the Firm’s Wilmington, Delaware office and practices in the Wills, Trusts & Estates group, as well as the Business Succession Planning and Real Estate groups. For more than 25 years, she has assisted businesses and individuals throughout Delaware. To best serve clients statewide, Kathy shares her time between the Firm’s Wilmington and Rehoboth Beach offices.

Kathy has extensive experience in estate planning, estate and trust administration, and probate matters, as well as elder law, including asset protection planning for long-term care (Medicaid and VA benefits). She regularly counsels clients on complex estate planning issues, including those affecting same-sex couples following Delaware’s marriage equality legislation. Notably, she handled the first same-sex adoption case in Delaware, setting precedent within the state.

Kathy also established the Firm’s Delaware Real Estate Closing Practice. She guides clients through every stage of residential and commercial transactions, including purchases, refinances, and 1031 exchanges, with a particular focus on commercial real estate. Her practice includes reviewing contracts, mortgage documents, titles, and surveys, preparing all necessary closing documents, and attending closings at locations convenient for her clients. Kathy’s cross-disciplinary approach allows her to provide a sophisticated level of service that integrates estate planning, business, and real estate considerations.

A frequent lecturer and presenter, she speaks on estate planning, estate administration, guardianships, elder law, and Medicaid-related matters. She is the Past President of the Southern Delaware Estate Planning Council and currently serves on its Board of Directors. Kathy is also the Past Chair of the Elder Law Section of the Delaware State Bar Association and is a certified mediator in estates and will contests, guardianships, family law, and related matters.

Kathy is deeply committed to community service. She regularly offers estate planning seminars regarding charitable giving to churches, is the Past Chair of the Finance Committee for Atonement Methodist Church, and presents quarterly seminars at the Newark, Delaware Senior Center on topics including estate planning, administration, guardianships, and Medicaid planning. She also provides monthly pro bono consultations at senior centers throughout Delaware. In addition, Kathy is an approved instructor for The Money School and conducts seminars across all three Delaware counties.

Outside the office, Kathy enjoys traveling and spending time with her husband, two children, and five grandchildren.
