Under Pennsylvania law, the ninety-day period typically begins on the first day of disability, which is defined as the first day of lost wages. (Galizia v. WCAB (Woodloch Pines, Inc.), 933 A.2d 146 (Pa. Cmwlth. 2007)).

The Commonwealth Court further clarified in Valley Stairs & Rails v. WCAB (Parsons), 202 A.3d 904 (Pa. Cmwlth. 2019), that the ninety-day period begins on the first day the claimant is unable to work due to the injury, generally the date of injury, unless the claimant is paid full wages for that day.

In short:

  • If the claimant is paid for the date of injury → the ninety-day period starts the next day.
  • If the claimant is not paid for that day → it starts on the date of injury.
