On Friday, September 22, 2023, Philadelphia partner James L. Griffith, Jr., presented a web-based CLE/CE course to insurance industry professionals entitled Did Someone Just E-Steal My 401(k)? A Look at Cyber & Privacy Liability Trends with a Focus on Fiduciary and Benefit Plan Liability. Using real-world examples, Jim demonstrated that retirement plans are vulnerable to cybertheft of plan assets (i.e. funds in a 401(k) account) and plan participant data (e.g. social security numbers). Jim, relying on his 25 years of ERISA experience, identified strategies for defeating the rising number of ERISA claims filed in response to such incidents, and covered recent Department of Labor activity in this area.
