Sharing his vast estate planning knowledge, Reger Rizzo & Darnall LLP Senior Counsel Joel S. Luber was recently published in the Pennsylvania Bar Association’s Real Property, Probate & Trust Law Section Newsletter.
In his article, “The Ascertainable Standard: The Good, the Bad, and the Misused and Misunderstood,” Joel examines the commonly used health, education, maintenance and support (HEMS) standard in trust agreements. Drawing on more than 40 years of estate planning experience, he explores the potential tax and creditor protection considerations associated with HEMS and challenges attorneys to reconsider whether this standard is always the best approach when drafting trusts.
Joel’s article appears beginning on page 21 of the Summer/Fall 2026 issue of the Real Property, Probate & Trust Law Section Newsletter.
