Update on the Statute of Limitations/Court Deadlines During Delaware's Judicial Emergency

The March 22nd Delaware Supreme Court Administrative Order offers an update on court deadlines and/or the Statue of Limitations that may arise during this Judicial Emergency. Some of the highlights include:
  • Any court deadline, statutory or ordinance deadline, statute of limitation, or statute of repose which would expire between March 23, 2020 and April 15, 2020 are extended to April 21, 2020.
  • If the deadline does not fall between March 23 and April 15, the deadline is not altered (this includes deadlines between April 16, 2020 and April 20, 2020).
  • Any deadline imposed via a court order remains the same, but courts have the discretion to extend the deadline for good cause shown.
You can access the March 22nd Administrative Order online here, as well as the previous March 16th Order (waiving any paper copy requirement to be sent to the court). To date, these are the only Orders given by the Supreme Court during this Judicial Emergency. The Supreme Court may amend these orders to extend the deadline, which they will post on the Delaware courts website.
