Smith Secures Defense Verdict in Jury Trial

RRD partner, Adam M. Smith, secured a Defense Verdict after a four (4) day jury trial in the Court of Common Pleas of Delaware County.

Adam M. Smith successfully defended the home buyer’s claims of Fraud, Fraudulent Misrepresentation, Negligent Misrepresentation, Violations of the Real Estate Sellers Disclosure Law, Violations of the Unfair Trade Practices and Consumer Protection Law, Negligence, Breach of Contract, and Breach of Fiduciary Duty asserted against Prudential Fox & Roach and its agents.

In a case involving a claim by a home buyer that the real estate professionals involved in the transaction breached their duties by failing to recommend a Home Inspection, failed to properly complete the Sellers Property Disclosure Statement, and then acted in a conflict of interest, Adam M. Smith utilized an old-fashioned poster board depicting a Home Inspection Notification Form to successfully win the Trial.

In fact, after less than one (1) hour of deliberations, the Jury had a single question: Can they award the payment of legal fees to the Defendants?
