RRD Partner, A. Kuhl, Obtains Favorable Verdict In His 40th Jury Trial

Partner Art Kuhl recently obtained a verdict in favor of the firm’s client following a jury trial in Superior Court in Delaware. This was Art’s 40th jury trial. Art negotiated an agreement pretrial that fixed the damages figure at an agreed amount, but preserved the client’s defense to liability. The case proceeded to trial solely on the issue of liability. The trial presentation included video evidence and expert witness testimony, in addition to the testimony of the parties. The jury returned its favorable verdict in less than an hour. The pretrial strategy not only reduced the client’s risk at trial, but also reduced the costs and expenses associated with trial, by streamlining the issues. This was an excellent example of a litigation strategy that managed risks and costs, while aggressively pursuing the client’s position that it was not liable on the claim.
