Arthur D. Kuhl Obtains Favorable Verdict from Delaware Supreme Court
Arthur D. Kuhl, Partner in Reger Rizzo & Darnall’s Insurance Practices Group, recently obtained a favorable verdict from the Delaware Supreme Court on behalf of his client.
The case originally claimed that the Plaintiff suffered a premature birth and subsequent birth defects as a result of a 2011 automobile accident. The initial claim was dismissed after Mr. Kuhl showed that there was a lack of a proper expert opinion proving that the Plaintiff’s injuries were caused by the 2011 accident.
The Plaintiff appealed the initial decision and oral arguments were heard in the Delaware Supreme Court on January 14, 2015. On January 27, 2015 the Delaware Supreme Court affirmed the trial court’s dismissal, stating that the trial court properly found plaintiff's expert witness's opinion legally insufficient.
